Terms of Service
A one-time license, plain and fair. Here is what you agree to when you use MixDesk.

These Terms of Service ("Terms") are an agreement between you and Gopher Tech, LLC ("Gopher Tech", "we", "us") governing your use of the MixDesk application ("MixDesk" or the "Software") and the mixdesk.app website. By downloading, installing, or using MixDesk, you agree to these Terms. If you do not agree, do not use the Software.
The license we grant you
When you buy a MixDesk license, we grant you a personal, non-exclusive, non-transferable license to use MixDesk. The license is for your own use on the Macs you personally own or control, for a reasonable number of your devices. It is a one-time purchase: pay $9 once and the license does not expire and is not a subscription.
Your license key is yours to use, not to publish. Please do not share, resell, sublicense, or post your key, and do not try to defeat the licensing or generate keys. A license is issued to you; if you need it on a new Mac, just use your key there.
Free trial, and what is free versus paid
MixDesk offers a free 14-day trial with full features and no credit card required. After the trial ends, live audio meters remain free forever. Muting apps and per-app volume control require a one-time license. We may adjust which features are free versus paid in future versions, but we will not take away paid features you have already licensed.
Updates
MixDesk can check for and install updates automatically. We may release updates that add, change, or remove features and that improve security and compatibility. We are not obligated to provide updates, support, or continued availability of any particular feature indefinitely.
Acceptable use
You agree not to reverse engineer, decompile, or disassemble the Software except to the extent that applicable law expressly permits, and not to use MixDesk in any unlawful way or in a way that infringes others' rights.
Intellectual property
MixDesk, its name, and its associated materials are owned by Gopher Tech, LLC and are protected by law. These Terms do not transfer any ownership to you; you receive only the license described above. MixDesk is not affiliated with, endorsed by, or sponsored by Apple Inc.
No warranty
The Software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with every configuration. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Gopher Tech, LLC and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the Software. To the maximum extent permitted by law, our total liability for any claim relating to the Software will not exceed the amount you paid for your license in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
Refunds
Purchases are covered by our Refund Policy, which is part of these Terms.
Termination
These Terms apply for as long as you use MixDesk. If you materially breach them, your license may end. You may stop using MixDesk at any time. The sections on intellectual property, no warranty, limitation of liability, and governing law survive termination.
Changes to these Terms
We may update these Terms from time to time. When we do, we will update the date at the top of this page. Continued use of MixDesk after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. This does not deprive you of the protection of mandatory consumer laws in your place of residence.
